시험용 각성제

베커-포스너 블로그의 게시물을 보다가 발견한 내용이다. 게리 베커는 정부가 학생들이 지적 활동을 강화하기 위해 약물을 복용하는 것을 금지해야 할 이유를 찾지 못하고 있다.

"All in all, even aside from enforcement issues, I see little reason for governments to ban the use of Provigil and other stimulants that improve cognitive performance. There are some situations where this improvement mainly benefits users at the expense of harm imposed on their competitors. For the most part, however, potential users are the best judge of whether they should use stimulants since they bear the lion's share of the costs as well as receive the benefits."

한편 포스너 판사는 일단 그 논의를 둘러싼 주변 상황을 요약하면서, 이것이 미국에서 현재 벌어지고 있는 약물 파동에 대한 코멘트로부터 출발하고 있다는 점을 적시한다. '순수한 인간 승리'를 맛보고 싶어하는 스포츠 팬들은 주최측에 약물 검사를 요구하게 마련이며, 그것을 적발하고 말고는 주최측의 결정에 달린 문제이지만, 굳이 법적으로 처벌하게 되면 걸린 사람만 큰 손해를 볼 뿐 그에 합당한 공익이 달성되지는 않는다는 것이 그의 주장이다. 약물 복용을 금지하는 이유는 약에 취한 사람이 주변에 끼칠 해악의 가능성이 크기 때문이라는 전제를 유지하고 있으므로, 그는 결국 '학생이 시험을 앞두고 공부하는 약을 먹는 것을 국가가 금지해야 할 이유는 없다'는 결론에 도달하게 된다.

"What is a possible source of concern is that because there is competition based on intelligence, for example to get into good schools or win academic prizes or achieve success in commercial fields such as finance that place a premium on intellectual acuity, the availability of intelligence-enhancing drugs places pressure on persons who would prefer not to use them because of concerns over their possible negative health consequences to use them anyway. There is also a danger that such drugs produce only very short-term effects, for example on exam performance, that may exaggerate a person’s long-term ability. (This is one of the reasons for objecting to exam coaching.) But against this is the fact that it is even more difficult than in the case of sports doping to draw a line between permitted and forbidden uses of cognition-enhancing drugs. It is hard to define "normal" cognitive functioning in a meaningful sense. Should people with an IQ above 100, which is the average IQ, be forbidden to use such drugs, but people below that level permitted to use them until it brings them up to 100? That would be absurd. The person with an IQ of 120 would argue compellingly that he should be allowed to take intelligence-enhancing drugs in order to be able to compete for good school placements and jobs with people having an IQ of 130. And so on up.

Of course the naturally gifted will object to any "artificial" enhancements that enable others to compete with them. But it is not obvious why their objections should be given weight from a public policy standpoint."

하지만 문제는 그러한 경쟁이 과열로 치달을 경우, 결국 모든 학생들이 약을 먹고 공부해야 하는 상황에 직면하게 된다는 것인데, 베커와 포스너는 둘 다 그런 종류의 외부효과에 대해서는 특별한 고려를 하고 있지 않다. "South Korea and other countries have tried to use laws to cut down on private tutoring and other investments that increase the likelihood that a student may succeed in gaining entrance to top universities, where the number of acceptances remains constant. Presumably, these countries would want to ban students from taking various stimulants that improve their performance, perhaps at a risk to their health, but such bans are difficult to enforce."라고 하는 걸로 봐서 베커 또한 한국의 입시 경쟁에 대해 어느정도 들은 바는 있는 것 같지만, 그것이 낳는 극단적인 외부효과에 대해서는 거의 짐작을 하고 있지 못한 것으로 보인다.

한국에서 학생들이 각성제 대신 한약을 먹으며 공부하는 것은, 다행히도, 아직까지는 사람들이 '약물'에 대해 부정적인 시각을 견지하고 있기 때문이다(어쩌면 강남에서는 벌써부터 이 두 편의 글에서 언급되는 약물을 학생들에게 공급하고 있을지도 모르지만 확인할 길이 없으니 논외로 하자). 하지만 이와 관련된 사회적 현상들을 통해, 또한 이론적 개념화를 통헤 베커의 경제학 환원주의를 비판하는 것은 결코 쉽지 않은 일이다. 당장 논증할 수는 없지만 이런 식의 사고방식이 옳지 않다는 것 정도만을 기록해두는 선에서 일단 이 글을 마무리 짓도록 해야겠다.
